Failure to Wear a Helmet Should Be Negligence

Why wouldn't someone's failure to wear a helmet be a consideration in their claim? Everyone knows that even if a helmet is not required by law in the state where you live, one can save your life. Without one, what else is between your head and the pavement (or the other car)? Even little kids on their tricycles know they have to wear them, and why. To me, it is terribly negligent to fail to wear a helmet. There are never any minor injuries in motorcycle accidents; only very bad injuries. Then the bills for the medical care necessary to treat them skyrocket and who pays for that? You say that the at-fault driver's insurance pay for it, but what if that's not enough? Then these people have their financial futures ruined because they thought they were too cool to put on a helmet.
